Privacy Rights & Data Requests
Effective date: April 20, 2026
This page explains how U.S. users of Avaplicity can submit privacy requests (e.g., access, deletion, correction, portability) and how we verify and process those requests. It is incorporated by reference into our Privacy Policy.
Scope
This page covers Avaplicity's phone-first services, website, and any optional web or iOS surfaces for individual U.S. users age 18+. For how we collect, use, and share information (including phone number, call-request data, telephony metadata, audio, recordings, transcripts, notes, structured next-step context, push tokens, and diagnostics where applicable), see our Privacy Policy and current Subprocessors. We do not sell or share personal information as those terms are defined under U.S. state privacy laws; if this changes, we will update this page and our Privacy Policy. We may honor Global Privacy Control (GPC) signals on the Website where required by law.
Your rights (summary)
- •Access / Know: Receive a report describing the categories and specific pieces of personal information we maintain about you.
- •Portability: Receive certain information in a portable, machine-readable format.
- •Correction: Request that we correct inaccurate personal information we maintain about you.
- •Deletion: Request deletion of your personal information, subject to legal and operational exceptions.
- •Opt-outs (as applicable): Opt out of "sale" or "sharing" for cross-context advertising and certain profiling. Note: we do not sell or share personal information and we do not use interest-based advertising cookies at this time.
- •Non-discrimination: We will not discriminate against you for exercising your privacy rights.
Some rights vary by state. We process requests consistent with applicable U.S. state privacy laws.
How to submit a request
Email privacy@avaplicity.com using one of the following subject lines:
- •
Data Request: Access (or Know) - •
Data Request: Portability - •
Data Request: Correction - •
Data Request: Deletion
You may submit a request using the email associated with your account, or, if you use Avaplicity through phone-first early access, by providing the phone number you used with Avaplicity and enough information for us to verify you. Include a brief description of your request. If you are acting as an authorized agent (see below), include proof of authorization.
If we add an in-product request flow, we'll link it here.
Verification
We must reasonably verify that you are the account holder (or their authorized agent) before fulfilling a request. We may verify requests by confirming control of a registered email address, sending a code to a registered phone number, arranging a callback, or asking you to use an available in-product verification step. If we need more information to verify, we will contact you. We will not require more data than necessary for verification.
Authorized agents (California and similar laws)
If you submit a request through an agent, we may require: (a) a signed, clear authorization from you; and (b) separate verification that you made the request (or that the agent holds a valid power of attorney). We may reject requests where authorization or identity cannot be verified.
Response timelines
- •Initial response: We strive to acknowledge receipt promptly.
- •Fulfillment: We aim to respond within 45 days of receiving a verifiable request. If reasonably necessary, we may extend once by up to 45 additional days and will inform you of the reason for the extension.
- •Frequency: For certain requests (e.g., "access/know"), we may provide information up to twice in a 12-month period.
If we deny your request (in whole or in part), we will explain why and how to appeal.
Appeals (Virginia, Colorado, and similar)
If we deny your request, you may appeal by emailing privacy@avaplicity.com with the subject line "Appeal: Privacy Request" and a brief explanation. We will review and respond within the time required by applicable law, and we will provide further recourse information if we deny the appeal.
What you can expect to receive
- •Access/Portability: A description of the categories of data we maintain about you and, where feasible, a copy of specific pieces of information (e.g., account profile, call-request data, telephony metadata, transcripts or notes if retained, structured next-step or execution-context records, device/app identifiers, and product-interaction diagnostics) in a commonly used format.
- •Correction: We will correct inaccurate personal information in our systems (and instruct our processors to do the same) where feasible.
- •Deletion: We will delete personal information we maintain about you, subject to lawful exceptions (e.g., to defend legal claims, detect security incidents, or comply with records obligations). Deletion may include de-identification where direct deletion is not feasible.
Some operational logs and security records may be retained for short periods to ensure reliability and safety. See Data Retention in our Privacy Policy.
Limits & exceptions
We may deny or limit a request, for example, if we cannot verify your identity, if fulfilling it would adversely affect others' rights, if legal obligations require retention, or if an exception applies under state law. We do not provide copies of model weights or internal security logs.
