Acceptable Use Policy
Effective date: September 15, 2025
This Acceptable Use Policy ("AUP") describes rules that apply when you use the Avaplicity website, iOS app, and related services (collectively, the "Services"). This AUP is part of and incorporates by reference our Terms of Use. If you violate this AUP, we may take action including content filtering, feature limits, account suspension, or termination.
Who may use the Services
- •Age. You must be 18 or older to use the Services.
- •Territory. The Services are intended for use in the United States.
- •Your account. You're responsible for the security of your account and devices and for all activity under your account.
At a glance: what's not allowed
- •Illegal activity, IP infringement, or violating others' rights.
- •Harassment, hate, exploitation, or doxxing; sexual content involving minors; sexualization of minors in any form.
- •Violence or threats; instructions that meaningfully facilitate harm (e.g., creating weapons or malware).
- •Impersonation of others, including using voice features to mimic a real person without consent.
- •Collecting, storing, or sharing others' personal data without consent; posting private or sensitive information.
- •Trying to break, bypass, scrape, or overload the Service; reverse engineering or model extraction.
- •Submitting highly sensitive data (e.g., protected health information) to the Service.
Prohibited conduct
1) Unlawful or rights-infringing activity
- •Violating any law or regulation.
- •Infringing or misappropriating intellectual property, publicity, or privacy rights.
- •Deceptive or fraudulent activity, including scams, impersonation, and phishing.
2) Safety, harassment, and sensitive content
- •Harassment, bullying, hate or discrimination toward protected classes.
- •Sexual content involving minors, or sexualization of minors in any form. Zero tolerance.
- •Graphic violence, threats of violence, or content that meaningfully facilitates self-harm or harm to others.
- •Doxxing or posting another person's personal data (address, phone, financial data, health data) without consent.
3) Security, network abuse, and service integrity
- •Introducing malware, spyware, or other malicious code.
- •Probing, scanning, or testing the vulnerability of any Avaplicity system or network; circumventing security or authentication.
- •Interfering with or disrupting any user, host, or network (e.g., DDoS, flooding, overloading, mail-bombing).
- •Circumventing technical controls (rate limits, feature gates, geo/age restrictions) or metering (usage/entitlements).
- •Scraping or mass-harvesting content or metadata from the Services without prior written permission.
4) AI/voice and media-generation restrictions
- •Impersonation: Do not use voice or other features to mimic a real person without that person's legally valid consent.
- •Misuse of outputs: Don't present generated content as factual without independent verification. Do not use outputs to deceive, defraud, commit academic dishonesty, or violate others' rights.
- •Model or dataset extraction: Do not attempt to extract model weights, recreate proprietary datasets, or train models to replicate the Services.
- •Harmful instructions: Do not request or disseminate content that meaningfully facilitates wrongdoing (e.g., weapon construction, explosive recipes, targeted violence, malware creation, or evading law enforcement).
5) Data and privacy
- •Don't submit protected health information (PHI) or other highly sensitive data.
- •Don't upload content you don't have the right to share (e.g., confidential or proprietary information of others).
- •Don't collect, process, or disclose others' personal data via the Services without their consent and a lawful basis.
- •If you use voice recording, comply with all applicable recording-consent laws (some states require two-party consent).
6) Platform misuse
- •Spamming, bulk or automated messaging, or unsolicited advertising using the Services.
- •Commercializing the Services without permission (e.g., resale, white-labeling, or offering the Services to third parties as a service).
- •Benchmarking or publishing performance comparisons in a misleading way or to discredit the Services.
Usage limits and technical controls
We may enforce reasonable technical limits (e.g., rate limits, concurrency, storage, conversation length) and may throttle, filter, or block content to protect users and service integrity.
Third-party services and app stores
Certain features rely on third-party services (e.g., Apple Sign-in, Google Sign-In, Firebase Auth, push notifications, subscription processing via Apple IAP/RevenueCat). Your use of those features must comply with those providers' terms as well as this AUP. You remain responsible for charges, data usage, and compliance with applicable policies.
Reporting abuse & enforcement
If you believe this AUP is being violated, please report details to privacy@avaplicity.com. We review reports and may take action at our discretion, which can include content removal, feature limits, account suspension or termination, preservation of evidence, and referral to law enforcement when required.
Changes
We may update this AUP from time to time. If changes are material, we will provide additional notice (e.g., in-app or by email). Your continued use of the Services after an update constitutes acceptance.
